Brussels: an EPC factor still active for older leases
Unlike Wallonia (whose EPC capping window ended late October 2023, with an adapted method remaining for capped EPC D-G leases), Brussels maintains the corrective coefficient for leases signed before 14 October 2022. For those leases, the calculation is:
Indexed rent = Base rent × (New index ÷ Base index) × EPC coefficient

Does the EPC apply to my Brussels lease? + −
Only if your lease was signed before 14 October 2022 and the property is rated E, F or G. For leases signed from 14 October 2022 onwards, indexation follows the federal standard formula, regardless of the EPC.
What are the EPC coefficients in Brussels? + −
Under art. 224/2 § 1bis/2 of the Brussels Housing Code: EPC A to C: 100 % indexation, EPC D-E: 75 %, EPC F-G: 0 % (full freeze). The coefficient may vary depending on the anniversary month (degressive mechanism over 12 months).
My Brussels lease dates from June 2021 with EPC G: am I entitled to index? + −
No. The EPC G coefficient is 0 % in Brussels for leases signed before 14 October 2022. You cannot apply any indexation as long as you remain in this category. An energy renovation (upgrade to E, D or better) could unlock the situation for future indexations.
Does an unknown EPC equal 0 %? + −
For post-October 2022 leases, the absence of an EPC has no impact (federal calculation). For earlier leases, the absence of an EPC effectively equals 0 % possible indexation — an EPC certificate must be issued in order to index.
What if the tenant disputes the calculation? + −
The calculation applying the legal formula and official Statbel indexes is technically opposable. In case of persistent disagreement, the justice of the peace decides free of charge upon simple petition.
