Can the landlord apply indexation retroactively? +−
Yes, but only for the past three months. Beyond that, they lose the right to claim the difference.
Is rent indexation mandatory? +−
No, it is a right of the landlord, not an obligation.
What if my landlord's calculation differs from yours? +−
The formula is public and identical for everyone. The justice of the peace settles disputes free of charge if needed.
My EPC rating is unknown — what should I do? +−
In Brussels and Wallonia, the absence of an EPC means 0% indexation is allowed (for leases signed after the regional cut-off dates).
What if my lease was signed before 2022? +−
EPC rules only apply to contracts signed or renewed after the regional cut-off dates (October 2022).
